Terms of Service
These Terms of Service govern your access to and use of Dottor Mail's 4-in-1 email deliverability and outreach platform, one-time credit packages, and APIs.
01.Acceptance of Terms
These Terms of Service (“Terms”) constitute a binding agreement between Dottor Mail SRL (“Dottor Mail,” “Company,” “we,” “us,” or “our”), registered in Turin, Italy, and the natural person or legal entity (“Customer,” “User,” or “you”) creating an account or using our platform.
If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. If you do not have such authority or do not agree with these Terms, you must not access or use the Services.
02.Description of Services & Tools
Dottor Mail provides a unified suite of 4 core deliverability and outbound tools accessible via our web application and REST APIs:
Algorithmic discovery of verified B2B email addresses based on professional domains and names.
12-layer syntax, DNS, MX, disposable, and real-time SMTP handshake validation.
Autonomous peer-to-peer synthetic network to build and recover mailbox reputation.
Outbound campaign dispatch with smart throttling, RFC 8058 compliance, and merge personalization.
03.One-Time Credits & Billing Policy
Dottor Mail operates strictly on a pay-as-you-go, one-time credit model. You purchase package credits when you need them. We will never charge your payment method recurring monthly or annual fees, and your purchased credits never expire as long as your account remains in good standing.
Credit Consumption Schedule:
- Email Verification: 1 credit per email verified (unknown or syntax error results are refunded or credited as per plan specs).
- Email Finder: 1 credit per successfully located and validated email address.
- Email Warmup: 1 credit per warm-up interaction executed in the peer network.
- Email Marketing: 1 credit per outbound campaign recipient sent.
Invoices are generated instantly upon purchase and made available in your dashboard with full European VAT compliance.
04.Account Registration & Credentials
You must be at least 18 years of age to register for an account. You agree to provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your account credentials and API keys. Any action performed through your account or API credentials will be deemed executed by you. You must notify us immediately at security@dottormail.com if you discover unauthorized access.
05.Acceptable Use Policy (Strict Anti-Spam)
You agree to strictly comply with all applicable email marketing laws, including the CAN-SPAM Act, Canada’s Anti-Spam Legislation (CASL), EU ePrivacy Directive, and GDPR.
You expressly represent and warrant that you will NOT:
- Upload purchased, rented, or third-party harvested lists of unknown consent.
- Send messages containing deceitful headers, misleading subject lines, or forged sender domains.
- Omit a valid, working physical postal address and automated one-click unsubscribe mechanism in marketing campaigns.
- Attempt to reverse-engineer, decompile, or bypass rate limits of Dottor Mail APIs.
- Distribute illegal, defamatory, adult, or discriminatory content.
06.Refund & Credit Expiry Terms
Because Dottor Mail provides intangible digital goods with real-time computational costs:
14-Day Money-Back Guarantee on Unused Packages: You are entitled to a full refund within 14 calendar days of purchase if zero credits from the package have been consumed.
Consumed Credits: Once credits have been consumed for list verification, email discovery, warmup routing, or outbound campaign sending, fees for consumed credits are non-refundable.
Credits Never Expire: Your credits do not expire at the end of the month or year. They remain available in your account balance until used.
07.Customer Data Ownership & Zero Retention
You retain full, exclusive ownership of all customer lists, email addresses, and campaign content uploaded to the Services. Dottor Mail claims zero ownership over your customer data.
Under our Zero List Retention architecture, verification lists are held in encrypted cache only for your operational download window (maximum 30 days) and are then automatically purged. We will never sell, lease, or cross-reference your lists against other customer databases.
08.Availability & Service Level Objective
We strive to maintain a 99.9% uptime availability for our core APIs and verification engine. However, we do not warrant that the Services will be uninterrupted or error-free at all times due to scheduled maintenance, upstream ISP outages, or third-party mail server throttling.
09.Limitation of Liability & Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOTTOR MAIL SRL AND ITS DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REPUTATION, OR BUSINESS INTERRUPTION.
OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO DOTTOR MAIL DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10.Indemnification
You agree to defend, indemnify, and hold harmless Dottor Mail SRL from and against any claims, liabilities, damages, judgments, awards, losses, costs, and legal fees arising out of or relating to your violation of these Terms, your marketing campaigns, or your violation of third-party rights or anti-spam regulations.
11.Governing Law & Italian Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Italy and the European Union, excluding its conflicts of law principles.
The competent Court of Turin (Tribunale di Torino), Italy, shall have exclusive jurisdiction to settle any dispute or controversy arising out of or in connection with these Terms or the use of the Services.
